Does the Workers’ Comp Doctor Work for Your Employer?

Yes. Under Missouri law, the employer has the right to select the treating doctor and must provide medical care that is reasonably required to cure and relieve the effects of the work injury (see § 287.140, RSMo). If you choose to treat with your own physician without authorization, that treatment may be at your own expense. In practice, employers often delegate the provider-selection process to the workers’ compensation insurer or claims administrator, but the authorized treating physician is still expected to make treatment decisions using independent medical judgment.

It is important to note that while the employer usually delegates the right to select the health care providers to the insurance company, it is the employer’s right. Therefore, if the employer and the insurance company disagree on this matter, the employer’s wishes should prevail.
